HOMEOWNERS AFFIDAVIT FOR BUILDING PERMIT
Across Tennessee there has been a dramatic increase in the number of homeowners pulling permits for residential structures. While this is a perfectly legal process for a homeowner wishing to build their own home, it is often an act being requested by their contractor who may not be licensed by the State of Tennessee and therefore unable to pull the permit under the contractors name.
While again it is legal under state law for the homeowner to pull the permit within certain guidelines, we want to make sure that the homeowner and permitting authorities understand the rights and responsibilities that the homeowner assumes when they make the decision to proceed in this manner.
Share with the permitting authority in your area the HOMEOWNERS AFFIDAVIT FOR BUILDING PERMIT and ask that they start requesting all homeowners who are pulling their own permit to complete it for the file. While there is no legal requirement that they do this, it could alleviate possible confusion and problems in the future should there be legal questions regarding rights and responsibilities between the homeowner and contractor.
